MAXIWALL PRO License Agreement


SINGLE USER PRODUCT – This is a legal agreement between you, the end user, and Terraforce CC (registration number 2003/083616/23) (“Terraforce”). By installing and/or running the programme, you are agreeing to be bound by and adhere to the terms of this License Agreement. If you do not agree to the terms of this agreement, promptly return to Terraforce the disk and all accompanying documentation for full refund.


1. GRANT OF LICENSE – Terraforce grants you the non-exclusive, personal, non-transferrable rights to use one copy of the enclosed Maxiwall Pro software program on a single computer. Terraforce shall be entitled to revoke the aforesaid rights at any time. The Maxiwall Pro software program is in ‘use’ on a computer when it is loaded temporarily into memory (i.e. RAM) or installed into permanent memory (e.g., hard disk, CD ROM, or other storage device) of that computer.


Installation of Maxiwall Pro software program for use or distribution to multiple computers on a public domain bulletin board, is strictly prohibited. You may only use the Maxiwall Pro software for the purpose for which Terraforce makes it available to you. You may not use it for any other purpose.


2. COPYRIGHT – The Maxiwall Pro software program is owned by TERRAFORCE and is protected by copyright laws, international treaty provisions, and all other applicable national laws. Therefore, you must treat the Maxiwall Pro software like any other copyrighted material (e.g., a book), except that if the software is not copy protected you may either make one copy of the Maxiwall Pro software solely for backup or archival purposes, or transfer the software to a single hard disk provided you keep the original solely for backup or archival purposes.


You may NOT copy the program manual or written materials accompanying the software.


3. OTHER RESTRICTIONS – You may not rent or lease the Maxiwall Pro software. You may not reverse engineer, decompile, or disassemble the Maxiwall Pro software.


DISCLAIMER


Anyone making use of the computer software program Maxiwall Pro does so at their own risk and assumes any and all liability resulting from such use. Terraforce shall not be liable for any damage, injury, loss, cost or expense (“Losses”) arising from or relating to your use of the Maxiwall Pro software or reliance on any calculations performed by using the Maxiwall Pro software. You indemnify Terraforce, its directors, officers, employees, contractors and agents against any claims relating to any Losses. Design calculations performed by Maxiwall Pro should be checked and verified by a registered Professional Engineer who is familiar with the site conditions and project materials.


The calculations performed by Maxiwall Pro, the Design Software for Segmental Retaining Walls are for PRELIMINARY PURPOSES ONLY.


While every effort has been made to ensure the accuracy of the information and programming provided in the Maxiwall Pro software program, it should NOT be relied upon for any specific application without independent competent professional examination and verification of its accuracy, suitability, and applicability. The information utilized by and produced from Maxiwall Pro, including but not limited to, all technical and engineering data, figures, tables, designs, drawings, details, and suggested specifications are for general analyses only. Because soils, drainage, emplacement problems, and other site specific conditions may vary, such general analyses should not be used or relied upon as being accurate, adequate, or suitable to produce a desired result at a specific site.


The final design should be based on project specific geometry, loadings, soils, and other materials used in the construction. Maxiwall Pro contains DEFAULT values for all data inputs that the user MUST change or verify as appropriate for the wall system components and project conditions being analyzed. These DEFAULT values do NOT ensure a conservative design for any wall component or site condition. The final design should provide for proper wall drainage to prevent the buildup of hydrostatic pressures over the service life of the structure.


NOTE that GLOBAL STABILITY of the structure, including the surrounding/underlying soils and groundwater conditions are NOT considered by the computer program, Maxiwall Pro. It is also recommended that an independent assessment of the settlement potential and wall deflections for the proposed structure be performed. These additional potential failure modes should be evaluated by the Engineer of record prior to initiating wall construction.


The Maxiwall Pro software has been tailored solely for Terraforce blocks. When in doubt, contact Terrasafe for further advice.


TERRAFORCE and the authors of this programme make no warranties or representations, express or implied, in respect of the Maxiwall Pro software. Without limiting the generality of the aforesaid, Terraforce disclaims any and all express or implied warranties of merchantability, fitness for any general or particular purpose or freedom from infringement of any patent, trademark, or copyright in regard to the program, design calculations, information or products contained or referred to herein.


Nothing herein contained shall be construed as granting a license, express or implied, under any patents, designs or trade marks. All rights reserved.


No part of Maxiwall Pro, i.e., the Design Software for Segmental Retaining Walls, may be reproduced in any form without permission in writing from the publisher, TERRAFORCE.
